By accessing or using Detourly (the "Service"), including our mobile application and website at detourly.app, you agree to be bound by these Terms of Service ("Terms") with Detourly LLC. If you do not agree, you may not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes your acceptance of the updated Terms.

2. Description of Service

Detourly LLC operates a personal companion app for shopping discoveries and route planning. It helps users find garage sales, estate sales, antique shops, and other points of interest along their travel routes. The Service provides discovery, mapping, and review functionality.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• You may not create accounts using automated means or under false pretenses.
• We reserve the right to terminate accounts that violate these Terms.

5. User Content

By submitting reviews, ratings, or other content ("User Content") to the Service:

• You grant Detourly LLC a non-exclusive, royalty-free, worldwide license to use, display, and distribute your User Content in connection with the Service.
• You represent that you own or have the necessary rights to submit the User Content.
• You agree not to submit content that is false, defamatory, obscene, illegal, or that infringes on any third party's rights.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Harvest or collect user data without authorization
• Use automated tools to access or scrape the Service without our consent
• Impersonate any person or entity
• Submit false, misleading, or fraudulent content

7. Intellectual Property

The Service and its original content, features, and functionality are the exclusive property of Detourly LLC and its licensors. The Detourly name, logo, and all related marks are trademarks of Detourly LLC. You may not use our trademarks without prior written consent.

8. Location Services

The Service uses location data to provide route planning and discovery features. Location access is optional — you may disable it in your device settings, though certain features will not be available without it. We do not share your real-time location with other users.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. DETOURLY LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. EVENT AND SALE LISTINGS ARE PROVIDED BY THIRD PARTIES AND WE DO NOT GUARANTEE THEIR ACCURACY OR AVAILABILITY.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DETOURLY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR AMOUNTS YOU PAID US IN THE PAST 12 MONTHS.

11. Termination

We may suspend or terminate your access at any time, with or without cause. You may terminate your account at any time through the account deletion process in Settings.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.
